They are, above all, guaranteed by the Constitution, and then specified in the Public Information Act and the Public Broadcasting Act. Serbia also ratified the most important international treaties safeguarding freedom of thought and press freedom \u2013 the International Covenant on Civil and Political Rights and the European Convention for the Protection of Human Rights and Fundamental Freedoms. Under the Constitution, freedom of expression may be restricted solely in exceptional cases which are exempted in accordance with the limitations set by international acts. Prohibition of the dissemination of information via media is also in accordance with international norms. Such a prohibition is possible in order to prevent incitement to a violent overthrow of the system in the country or violation of its territorial integrity, to prevent warmongering or instigation to direct violence and advocacy of racial, ethnic or religious hatred which fosters discrimination, hostility or violence \u2013 by way of a court decision only, and if necessary in a democratic society.<a href=\"#sdfootnote1sym\" name=\"sdfootnote1anc\">1<\/a><\/p>\n<p align=\"justify\"><span lang=\"en\">However<\/span><span lang=\"en\">, the existence of <\/span><span lang=\"en\">institutional<\/span> <span lang=\"en\">and legal structure<\/span> <span lang=\"en\">is a prerequisite<\/span> <span lang=\"en\">but not<\/span> <span lang=\"en\">itself<\/span> <span lang=\"en\">a sufficient condition<\/span> <span lang=\"en\">for<\/span> <span lang=\"en\">the exercise of freedom<\/span> <span lang=\"en\">of the media in<\/span> <span lang=\"en\">all its glory<\/span><span lang=\"en\">. <\/span><span lang=\"en\">What is very<\/span> <span lang=\"en\">peculiar<\/span> <span lang=\"en\">in Serbia<\/span> <span lang=\"en\">is that<\/span> <span lang=\"en\">adopted laws<\/span> <span lang=\"en\">and regulations<\/span> <span lang=\"en\">have become<\/span> <span lang=\"en\">a dead letter<\/span><span lang=\"en\">, and the <\/span><span lang=\"en\">reality of everyday<\/span> <span lang=\"en\">life<\/span> <span lang=\"en\">remains unchanged<\/span><span lang=\"en\">.<\/span><\/p>\n<p align=\"justify\">According to the survey of news media editors-in-chief, only 22% of media outlets did not experience some form of violation of media freedom in their everyday work. Out of those who did, one third (34%) were denied access to information of public importance; another third of them (30%) received unequal treatment, compared to other media, at the hands of the sources of informati on; one fourth (27%) had their advertising contracts cancelled, and another fourth of them (26%) experienced interference in their editorial policies (in the form of a ban on publication of certain information, designation of \u201cdesirable\u201d and \u201cundesirable\u201d content, etc.). As the sources of greatest pressure exerted on their media, the surveyed media editors named the ruling political parties (47%), organs of executive power (32%), opposition parties (26%), and, in the same measure, private companies in their capacity as advertisers (16%) and public enterprises (16%).2<\/p>\n<p align=\"justify\">According to Michael Davenport, Head of the EU Delegation in Serbia, three phenomena currently affect freedom of expression in Serbia &#8211; self-censorship, hacking websites and intimidation of individuals who were detained and arrested for comments on social networks. Controversy about alleged censorship in the media started during the recent floods, when some websites criticising the government&#8217;s handling of the crisis were taken down as a result of hacker attacks.3<\/p>\n<p align=\"justify\"><img decoding=\"async\" class=\"aligncenter wp-image-3119 size-medium\" src=\"http:\/\/iea.rs\/wp-content\/uploads\/2015\/02\/jkessay2-800x574.jpg\" alt=\"jkessay2\" width=\"696\" srcset=\"https:\/\/iea.rs\/wp-content\/uploads\/2015\/02\/jkessay2-800x574.jpg 800w, https:\/\/iea.rs\/wp-content\/uploads\/2015\/02\/jkessay2-473x339.jpg 473w, https:\/\/iea.rs\/wp-content\/uploads\/2015\/02\/jkessay2-726x521.jpg 726w, https:\/\/iea.rs\/wp-content\/uploads\/2015\/02\/jkessay2.jpg 959w\" sizes=\"(max-width: 800px) 100vw, 800px\" \/><\/p>\n<p style=\"text-align: center;\" align=\"justify\">\u201e<span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\"><i>Freedom of the press is guaranteed only to those who own one.\u201c<\/i><\/span><\/span><span style=\"font-family: Times New Roman,serif;\"><span style=\"font-size: medium;\"> ~ Abbott Joseph Liebling<\/span><\/span><\/p>\n<p align=\"justify\"><span lang=\"en\">Unfortunately<\/span><span lang=\"en\">, we live <\/span><span lang=\"en\">in a time<\/span> <span lang=\"en\">of media<\/span> <span lang=\"en\">darkness that<\/span> <span lang=\"en\">devours<\/span> <span lang=\"en\">everything in its path<\/span><span lang=\"en\">. <\/span><span lang=\"en\">We put<\/span> <span lang=\"en\">locks<\/span> <span lang=\"en\">on<\/span> <span lang=\"en\">the hands of a clock<\/span> <span lang=\"en\">and<\/span> <span lang=\"en\">started<\/span> <span lang=\"en\">to live<\/span> <span lang=\"en\">in another time<\/span> <span lang=\"en\">out of<\/span> <span lang=\"en\">the hand<\/span> <span lang=\"en\">of reality.<\/span> <span lang=\"en\">The media<\/span><span lang=\"en\"> is <\/span><span lang=\"en\">undoubtedly a<\/span> <span lang=\"en\">dangerous tool<\/span> <span lang=\"en\">in the hands of<\/span> <span lang=\"en\">individuals<\/span><span lang=\"en\">, <\/span><span lang=\"en\">enabling them to<\/span> <span lang=\"en\">create public<\/span> <span lang=\"en\">opinion<\/span> <span lang=\"en\">by their own<\/span> <span lang=\"en\">needs.<\/span> <span lang=\"en\">The reason for this<\/span><span lang=\"en\">, <\/span><span lang=\"en\">as in most of<\/span> <span lang=\"en\">the problems<\/span> <span lang=\"en\">that has been plaguing<\/span> <span lang=\"en\">our society<\/span> <span lang=\"en\">is education<\/span><span lang=\"en\">. <\/span><span lang=\"en\">Considering the fact<\/span> <span lang=\"en\">that the level of<\/span> <span lang=\"en\">education<\/span> <span lang=\"en\">of the population<\/span> <span lang=\"en\">of the Republic of<\/span> <span lang=\"en\">Serbia<\/span> <span lang=\"en\">is very low<\/span><span lang=\"en\">, <\/span><span lang=\"en\">with<\/span> <span lang=\"en\">only a small proportion<\/span> <span lang=\"en\">of highly educated<\/span> <span lang=\"en\">people<\/span><span lang=\"en\">, <\/span><span lang=\"en\">who<\/span> <span lang=\"en\">are taught to<\/span> <span lang=\"en\">critically<\/span> <span lang=\"en\">observe<\/span><span lang=\"en\">, <\/span><span lang=\"en\">it is not surprising<\/span> <span lang=\"en\">that what<\/span> <span lang=\"en\">is received<\/span> <span lang=\"en\">as<\/span> <span lang=\"en\">information through the media<\/span><span lang=\"en\"> is <\/span><span lang=\"en\">adopted without<\/span> <span lang=\"en\">any<\/span> <span lang=\"en\">reserves<\/span><span lang=\"en\">. Since <\/span><span lang=\"en\">that there<\/span> <span lang=\"en\">is no investment<\/span><span lang=\"en\"> and reforms <\/span><span lang=\"en\">in<\/span> <span lang=\"en\">education<\/span><span lang=\"en\"> \u2013 we have to ask <\/span><span lang=\"en\">why<\/span><span lang=\"en\">?
